1. INTRODUCTION

Welcome to SpeediReply™. SpeediReply™ is a doing business as (DBA) name of XpandTEK, LLC (“XpandTEK,” “SpeediReply,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the SpeediReply™ website, software, and related communication automation tools (collectively, the “SpeediReply Services”).

By accessing or using the SpeediReply Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use the SpeediReply Services.


2. ELIGIBILITY

To access or use the SpeediReply Services, you must be at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement.

By using the SpeediReply Services, you represent and warrant that:

You are 18 years of age or older

You have the authority to enter into these Terms

If you are using the Services on behalf of a business or organization, you have the authority to bind that entity to these Terms

The SpeediReply Services are intended for business use and are not directed toward individuals under the age of 18.

XpandTEK reserves the right to suspend or terminate access to the Services if it becomes aware that a user does not meet the eligibility requirements.


3. SPEEDIREPLY SERVICES

SpeediReply™ provides AI-powered communication and customer engagement tools designed to help businesses respond to leads and customers more efficiently.

These services may include, but are not limited to:

Missed Call Text Back

Automated SMS and conversational messaging

AI-powered chat and intake workflows

Appointment scheduling and routing

AI-assisted voice and call handling

Each SpeediReply Service offers distinct functionality related to call handling, text messaging, scheduling, and automated customer communication.

Access to the SpeediReply Services may require a paid subscription following any applicable trial or demo period.

Pricing, features, and availability are listed on SpeediReply™ websites, funnels, or promotional materials and may be modified at XpandTEK’s discretion.


4. FREE TRIALS

XpandTEK may offer limited-time free trials for certain SpeediReply Services.

Trial availability, duration, and features may vary by promotion. Unless otherwise stated, trials are provided for evaluation purposes only and may include feature limitations.

At the end of a trial period, continued access to the SpeediReply Services will require activation of a paid subscription.

Users may be notified prior to trial expiration with instructions for upgrading. If no paid plan is activated, access to the Services may be suspended or terminated.


5. SUBSCRIPTIONS & BILLING

SpeediReply Services are offered on a subscription basis unless otherwise stated in writing.

All fees are due in advance and are non-refundable, except where required by law.

Payments are securely processed through a third-party payment provider such as Stripe. XpandTEK does not store credit card or banking information.

For billing clarity, charges may appear on your bank or credit card statement as:

“SpeediReply” or a similar SpeediReply-branded descriptor.

Failure to maintain an active subscription may result in suspension or termination of access to the Services.


6. ACCEPTABLE USE

You agree to use the SpeediReply Services only for lawful and legitimate business purposes.

You may not use the Services to:

Send spam, unsolicited, or abusive communications

Harass, threaten, or deceive individuals

Engage in illegal, fraudulent, or unethical activities

Violate applicable laws, carrier policies, or third-party platform rules

Send communications without proper consent where required by law

XpandTEK reserves the right to suspend or terminate accounts that violate acceptable use standards.


7. SMS COMMUNICATIONS

SpeediReply may enable SMS messaging functionality for businesses using the Services.

Users who provide their phone number and opt in may receive text messages related to:

Requested service information

Customer support communications

Appointment confirmations or scheduling notifications

Account alerts or service updates

Message Frequency

Message frequency may vary depending on the interaction.

Message & Data Rates

Standard message and data rates may apply depending on the recipient’s mobile carrier and service plan.

Opt-Out

Recipients may opt out at any time by replying:

A confirmation message may follow the opt-out request.

Consent

Consent to receive SMS messages is not a condition of purchasing any goods or services.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages.


8. CUSTOMER COMPLIANCE RESPONSIBILITY

Businesses using SpeediReply to communicate with customers are responsible for ensuring their communications comply with applicable laws and regulations including:

The Telephone Consumer Protection Act (TCPA)

CAN-SPAM Act

CTIA messaging guidelines

Applicable state and federal communication laws

Businesses must obtain proper consent before sending SMS communications.

SpeediReply provides communication tools but does not control how businesses use the Services.


9. DATA HANDLING

Any data collected, processed, or transmitted through the SpeediReply Services will be handled in accordance with our Privacy Policy.

Certain information may be retained temporarily for legal, security, or compliance purposes.


10. THIRD-PARTY SERVICES AND INTEGRATIONS

The SpeediReply Services may integrate with or rely on third-party services including but not limited to:

SMS and voice carriers

messaging platforms

payment processors

calendar systems

CRM platforms

XpandTEK is not responsible for the availability, policies, or performance of third-party services.

Use of such integrations is at your own risk and subject to the third party’s terms and policies.


11. NO GUARANTEES

While SpeediReply provides tools designed to improve response times, communication efficiency, and automation, XpandTEK makes no guarantees regarding:

lead volume

conversions

revenue

response rates

business outcomes

Use of the Services does not guarantee specific results.


12. DISCLAIMER OF WARRANTIES

The SpeediReply Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

XpandTEK does not guarantee that the Services will be uninterrupted, secure, or error-free.

Service interruptions may occur due to technical issues, third-party outages, or factors outside our control.


13. LIMITATION OF LIABILITY

XpandTEK, LLC shall not be liable for:

missed opportunities

lost income or revenue

lost leads or customers

data loss

business interruption

This includes damages arising from delayed or failed calls, messages, automations, system errors, service interruptions, carrier filtering, or technical issues.

Use of the Services is at your own risk.


14. LIMITATION OF LIABILITY (AGGREGATE)

To the maximum extent permitted by law, XpandTEK, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits or revenue.

XpandTEK’s total liability for any claim related to the SpeediReply Services shall not exceed the amount paid by you for the Services during the six (6) months preceding the event giving rise to the claim.


15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless XpandTEK, LLC and its affiliates, officers, employees, and partners from any claims, damages, liabilities, losses, or expenses arising out of:

your use of the Services

communications sent using the Services

violation of these Terms

violation of applicable laws or regulations


16. TERMINATION

You may cancel your SpeediReply account at any time by contacting:

Reactivation after cancellation may require a setup fee to restore and reconfigure the system.

XpandTEK may suspend or terminate your access if:

you violate these Terms

payment becomes overdue

suspension is required by law, carrier requirements, or security concerns

Upon termination, your right to use the SpeediReply Services will immediately cease.


17. CHANGES TO TERMS

XpandTEK may modify these Terms at any time.

If material changes are made, notice may be provided via email or by posting updated Terms on the SpeediReply website.

Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
